I believe that a Quincy has the innate ability to correctly identify the intensity of a target's spiritual energy signature. More specifically, a Quincy can theoretically measure the frequency and density, allowing them to differentiate between high and low points, which led to the result of the Bankai Capture Device's ability to steal Bankai. The device is able to steal Bankai that are within the category of high frequency and high density, meaning that the lower the frequency and density of the Bankai's spiritual energy wavelength, the less chances the device will successfully capture the Bankai. Furthermore, I ideally relate the Bankai Capture Device to function like that of a spiritual magnet, attracting charged substances that are within the range of its magnetic field. So I guess said that this hints to the device's weakness, as it is limited to only Bankai.
As for it's weakness, as encompassing as the capabilities are, the device is not perfect. Shinigami whom possess Bankai that are, ideally "compressed" (ie. Yamamoto's Zanka no Tachi or Ichigo's Tensa Zangetsu), are generally immune from the effects. It is often speculated that the reason for this is because the immense density exhibited by that particular Bankai is far too tightly-packed to be ripped away by the device. I can subsequently noted that Bankai that have extremely low densities, thus their wavelength is much more tightly-packed in and compressed. It is likened to a "vacuum cleaner" in this regard. The range of the device is limited, meaning it can only pick up on loose reishi particles. Therefore, compressed Bankai make it nigh impossible to steal the Bankai in question. Furthermore, Asumu noted that it'd be impossible to steal the Bankai while the Shinigami is in their Shikai state, for the energy is far too compressed.

so now the question is, can the bankai also be released and returned to the original owner of the bankai?
as it's stolen, can it be given back?
sasakibe's dead, but driscol, the overkill, was still able to use his bankai
as byakuya said: sasakibe mastered his bankai before Kyoraku and ukitake. (though not fully and perfectly mastered like Yamamoto)
also, his loyalty to the head captain was so great that instead of filling in absent captain positions, he chose to remain at
the head captain's side
so, i don't think something freaked him out, he simply stayed at the head captain's side as his lieutenant
also, just because no one has seen his bankai in 2000 years, doesn't neccesarily mean he didn't train it
and also something old man Yama revealed, the bankai the quincy steal and use, are not as powerful as the original ones
Plus i don't really think Kubo could put much depth in his explanations so
And yes, i noticed yama say that. Since to control a bankai, you actually need to train it. Its like catching a wild pokemon. They wont really let you use their abilities to the fullest. You must train it. :0
when you catch a wild pokemon, you befriend it, but its power level stays what it was
but the bankai, containing the zanpaktou spirit, partially at least, being alive, does not fully wish to cooperate with a thief like those quincies.
